Acceptance of Terms

By accessing or using Elio AI Logo Design Studio ("Elio", "the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. We reserve the right to update these Terms at any time, and your continued use of the Service constitutes acceptance of any changes.

Eligibility & Age Requirements

You must be at least 16 years of age to use the Service. Under the General Data Protection Regulation (GDPR), the age of digital consent — when an individual can legally consent to their personal data being processed by an AI service — is generally 16. However, individual EU/EEA member states may lower this threshold to as young as 13.

• 16+ years: You may use Elio and consent to data processing on your own behalf.
• 13–15 years (depending on country): You may only use Elio if consent is given or authorized by a parent or legal guardian. The applicable age varies by country (e.g., 13 in Belgium, Ireland, UK, Spain, Denmark, Sweden, Poland; 14 in Austria, Bulgaria; 15 in Finland, Greece, France; 16 in Germany, Netherlands, Hungary, Romania).
• Under 13: You may not use the Service under any circumstances.

By using Elio, you represent and warrant that you meet the applicable age requirement in your jurisdiction, or that you have obtained consent from a parent or legal guardian. We reserve the right to terminate accounts that do not meet these requirements.

Service Description

Elio is an AI-powered logo design platform that allows users to create artistic logos and brand imagery using various art styles including watercolor, oil painting, ink, charcoal, and more. The Service includes features such as AI image generation, background removal, image upscaling, and a personal design library.

The Service is provided on an "as is" and "as available" basis. We reserve the right to modify, suspend, or discontinue any part of the Service at any time without prior notice.

User Accounts

To use certain features of the Service, you must create an account using a supported authentication method: Google OAuth, Apple Sign In, or email and password. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to provide accurate and complete information when creating your account and to update your information as necessary. We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently.

Account Termination

You may delete your account at any time using the Delete Account option in Settings. Account deletion is permanent and will remove all your personal information, generated logos, credit history, and subscription data. This action cannot be undone.

We may also suspend or terminate your account at our discretion if we determine that you have violated these Terms, engaged in fraudulent activity, or otherwise misused the Service.

Credits & Billing

Credit System

Elio uses a credit-based system for AI features. Different actions consume different amounts of credits. Credit costs are displayed within the app before each action is performed. Free accounts receive a limited number of credits upon registration.

Subscriptions

Paid subscription plans provide recurring credit allocations. Subscription credits reset at the beginning of each billing period and do not roll over. You may cancel your subscription at any time.

iOS (App Store)

Subscriptions purchased on iOS are billed through Apple's App Store and are subject to Apple's terms and conditions. You may manage or cancel your subscription through your App Store account settings.

Web (Stripe)

Subscriptions purchased on the web platform are billed through Stripe. You may manage or cancel your subscription through the Manage Subscription option in Settings or by contacting us at the email address below.

Credit Packs

One-time credit pack purchases add credits to your account that do not expire and are not affected by subscription changes. Credit pack purchases are non-refundable except as required by applicable law.

Refunds

iOS: All iOS purchases are processed through the Apple App Store. Refund requests must be submitted through Apple's standard refund process. We do not process iOS refunds directly.

Web: Refund requests for web purchases should be directed to support@eliologo.com. Refunds are processed through Stripe and are subject to our refund policy and applicable law.

Intellectual Property

Your Content

You retain ownership of logos and images you create using Elio. By using the Service, you grant us a limited, non-exclusive license to store and process your content as necessary to provide the Service.

Our Content

The Elio name, logo, branding, user interface, and underlying technology are owned by us and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Service without our prior written consent.

AI-Generated Content

Images generated through Elio are created using AI models. While you may use generated images for personal and commercial purposes, we do not guarantee that generated content will be unique or free from similarity to existing works. You are responsible for ensuring your use of generated content complies with applicable laws and does not infringe on third-party rights.

Content Policy & Moderation

Elio employs automated content moderation to review all prompts and inputs before any AI-powered generation takes place. This system is designed to prevent the creation of harmful, illegal, or otherwise prohibited content. By using the Service, you acknowledge and agree to the following content policies.

Prohibited Content

The following categories of content are strictly prohibited on the Service. You may not use Elio to create, attempt to create, or request the creation of:

• Sexual or explicit content: Nudity, pornographic material, sexually explicit imagery, or any content of a sexual nature.
• Violence and gore: Graphic depictions of violence, gore, torture, mutilation, or any content that glorifies or promotes physical harm.
• Hate speech and discrimination: Content that promotes hatred, discrimination, or violence against any individual or group based on race, ethnicity, national origin, religion, gender, gender identity, sexual orientation, disability, or any other protected characteristic. This includes slurs, dehumanizing language, and symbols of hate.
• Child exploitation (zero tolerance): Any content that depicts, promotes, or facilitates the exploitation or abuse of minors in any form. This includes child sexual abuse material (CSAM), suggestive content involving minors, and any content that sexualizes children. Violations will result in immediate and permanent account termination and may be reported to the National Center for Missing & Exploited Children (NCMEC) and relevant law enforcement authorities.
• Illegal activities: Content that promotes, facilitates, or depicts illegal activities, including but not limited to drug manufacturing or trafficking, terrorism, weapons production, fraud, or any other criminal conduct.
• Self-harm and suicide: Content that promotes, encourages, or provides instructions for self-harm, suicide, eating disorders, or other forms of self-destructive behavior.
• Deepfakes and unauthorized depictions: Realistic or misleading depictions of real individuals created without their explicit consent, including deepfakes, manipulated likenesses, or any content intended to deceive others about a person's actions or statements.

Automated Moderation

Our content moderation system operates server-side before any AI generation occurs. Prompts that violate our content policy are rejected automatically and no credits are consumed. While we strive for accuracy, no automated system is perfect. If you believe a prompt was incorrectly rejected, you may contact us at support@eliologo.com.

Enforcement

Violations of this Content Policy may result in one or more of the following actions, at our sole discretion:

• Automatic rejection of the offending prompt or request
• Removal of generated content that violates these policies
• Temporary suspension of your account
• Permanent termination of your account without refund
• Reporting to law enforcement authorities where required by law

We reserve the right to review any content generated through the Service and to take action, including content removal and account termination, without prior notice. Repeat offenders will be permanently banned from the Service.

Reporting

If you encounter content generated through Elio that you believe violates this Content Policy, please report it to us at support@eliologo.com. We will review all reports and take appropriate action in a timely manner.

Acceptable Use

In addition to the Content Policy above, you agree not to use the Service to:

• Generate content that violates the Content Policy & Moderation section of these Terms
• Create content that infringes on intellectual property rights of others
• Attempt to gain unauthorized access to the Service or its infrastructure
• Interfere with or disrupt the Service or servers connected to the Service
• Use automated tools, bots, or scripts to access the Service without authorization
• Resell, redistribute, or sublicense access to the Service
• Circumvent credit limits, billing systems, or access controls
• Generate content depicting real individuals without their consent
• Attempt to bypass or circumvent content moderation filters

We reserve the right to remove content and suspend or terminate accounts that violate these guidelines, at our sole discretion and without prior notice.

Limitation of Liability

To the maximum extent permitted by applicable law, Elio and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of the Service.

Our total liability for any claim arising from or related to the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim. The Service is provided without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

Indemnification

You agree to indemnify and hold harmless Elio and its operators from any claims, losses, damages, liabilities, and expenses (including reasonable attorney's fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

Dispute Resolution

In the event of any dispute arising out of or relating to these Terms or the Service, you agree to first attempt to resolve the dispute informally by contacting us at support@eliologo.com. We will attempt to resolve the dispute through good faith negotiation within 30 days.

If the dispute cannot be resolved informally, it shall be resolved through binding arbitration in accordance with the rules of the applicable arbitration body in the jurisdiction in which we operate. You agree that any arbitration will be conducted on an individual basis and not as a class action or representative proceeding.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which we operate, without regard to conflict of law provisions.

Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms shall remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Elio regarding your use of the Service and supersede all prior agreements, understandings, and communications, whether written or oral, regarding the subject matter herein.
